1.    DEFINITIONS

1.1  WEBSITE means the domain at www.sports-investor.net


1.2  SUPPLIER means the owner(s) of WEBSITE


1.3  CONTENT means to all information including articles, opinion, selections, statistics, pictures or any other content delivered by SUPPLIER via WEBSITE, e-mail or any means whatsoever


1.4  USER means any person(s) accessing WEBSITE or accessing information delivered by SUPPLIER through any means whatsoever


1.5  SERVICE means the service offered by SUPPLIER


1.6  MEMBER means any person who creates an account at WEBSITE


1.7  BUYER means any person who makes a payment for SERVICE.


1.8  TERMS AND CONDITIONS means the terms and conditions for the provision of SERVICE contained in this agreement and any special terms and conditions agreed by SUPPLIER in writing.


 


2.    ACCEPTANCE OF TERMS


2.1  As a condition of viewing the WEBSITE, USER/MEMBER/BUYER agrees that his/her use of WEBSITE and CONTENT is subject to the exclusivity of TERMS AND CONDITIONS. If you do not agree to TERMS AND CONDITIONS in general or to any provision contained within TERMS AND CONDITIONS, please leave WEBSITE immediately.


 


3.    CONDITIONS


3.1  TERMS AND CONDITIONS shall apply to all contracts for the provision of SERVICE by SUPPLIER to USER/MEMBER/BUYER and shall prevail over any documentation or communication by USER/MEMBER/BUYER.


3.2  It is agreed that SERVICE is provided both through payment and in the absence of any payment. While SERVICE provided may vary depending on payment, it is agreed that these TERMS AND CONDITIONS shall apply even in the absence of any payment.


3.3 For the purpose of clarity, SUPPLIER clarifies that should any person(s) fall under multiple definitions in Clause 1, TERMS AND CONDITIONS applicable to each catrgory shall apply to such person(s). Thus, for example BUYER is also MEMBER and USER and the TERMS AND CONDITIONS appliable to USER, BUYER and MEMBER shall all apply to BUYER simultaneously.


 


4.    DESCRIPTION OF SERVICE


4.1  SUPPLIER offers service via WEBSITE containing information on upcoming sporting contests and information relating to various betting markets.


4.2  CONTENT is made available at WEBSITE and communicated via e-mail, SMS or any other means of communication and is provided for informational and entertainment purposes only.


4.3  Any odds or bookmakers quoted or profit or loss figures contained on WEBSITE are for the purpose of providing a possible objective measure of the quality of information contained and to allow any independent reviewers of the service to assess the quality of information contained. USER/MEMBER/BUYER agrees that this information does not constitute an encouragement or instruction to place a bet, wager or to in any way gamble.


4.4  If USER/MEMBER/BUYER belongs to a jurisdiction where it is legal to place bets, nothing contained in this agreement shall prevent him/her from using the information contained on WEBSITE do so on his/her own behalf only. However, USER/MEMBER/BUYER agrees that the views and opinions expressed through CONTENT including but not limited to selections do not constitute professional advice or instructions to in any way place a bet, wager or engage in any form of gambling or to conduct any action whatsoever.


4.5  SUPPLIER also allows BUYER the provision to purchase information not ordinarily accessible to USER/MEMBER. All such information is also covered by all Clauses of TERMS AND CONDITIONS.


 


5. COPYRIGHT


5.1  All information contained on WEBSITE constitutes intellectual property and is copyright SUPPLIER. USER/MEMBER/BUYER must not not modify, publish, transmit, transfer, sell, reproduce, create derivative work from, distribute, repost, perform, display, save or in any way exploit any of the CONTENT provided to him/her by SUPPLIER.


5.2  In the event that it is found that USER/MEMBER/BUYER violated Clause 5.1 above, USER/MEMBER/BUYER specifically agrees to compensate SUPPLIER for damages caused by this action, including but not limited to punitive damages.


5.3  SUPPLIER uses the brand name "SPORTS INVESTOR" for marketing purposes. SUPPLIER reserves the right to alter this name at any time without prior notice.


 


5.    ACCESS TO THE WEBSITE


5.1  SUPPLIER makes no claims regarding the ability of USER/MEMBER/BUYER to access WEBSITE. Moreover, SUPPLIER is in no way liable for the ability or inability of the USER/MEMBER/BUYER to visit WEBSITE or gain access to CONTENT or SERVICE though any means.


 


6.    CHANGES TO THE WEBSITE


SUPPLIER reserve the right to:


6.1  Change, permanently remove or alter the content of WEBSITE at any time without prior notice and USER/MEMBER/BUYER agrees that SUPPLIER shall not be liable for any such changes.


 


7.    CREATING AN ACCOUNT


7.1  USER may create an account using the ‘Subscription’ page of this website or using the ‘Register for free’ link or any other provisions made to enable USER to create an account. However, SUPPLIER reserves the right to bar USER from creating an account and SUPPLIER is in no way obligated to allow USER to create an account.


7.2  SUPPLIER may alter the procedure for creating an account at any time without prior notice of warning


7.3  SUPPLIER may restrict access to CONTENT at any time without prior notice or warning.


 


8.    SUBSCRIPTION ACCOUNTS


8.1  SERVICE at WEBSITE is offered in the form of subscriptions of varying length offered at different prices. SUPPLIER may alter the length or prices of available subscriptions at any time without prior notice or warning.


8.2  SUPPLIER may offer any specific USER/BUYER/MEMBER or any group of BUYERs/MEMBERs/USERs discounted prices or charge any specific USER/BUYER/MEMBER or any group of BUYERs/MEMBERs/USERs an extra charge for the provision of SERVICE. USER/BUYER/MEMBER holds SUPPLIER harmless from any consequences of such action.


 


9.    OBLIGATIONS OF USER/MEMBER/BUYER


9.1  USER/MEMBER/BUYER must be at least 18 years old to use the Website.


9.2  USER/MEMBER/BUYER must not belong to any entity considered a criminal enterprise by law-enforcement agencies including international law enforcement agencies.


9.3  USER/MEMBER/BUYER must be an individual person and must not be an artificial person (such as a company or any other institution). Moreover, USER/MEMBER/BUYER must act only on his own behalf while accessing and/or using the CONTENT on this WEBSITE and must not act on behalf of any other person(s) including but not limited to artificial person(s).


9.4  USER/MEMBER/BUYER must not allow any other person(s) to view, read, examine, copy, reproduce, transmit or utilize in any way the CONTENT of this WEBSITE.


9.5  USER/MEMBER/BUYER must provide valid contact details and accurate information during the registration process. USER/MEMBER/BUYER is also responsible for updating all information and keeping all such information current

9.7  USER/MEMBER/BUYER must not use the CONTENT to engage in any activity that violates any local, state, national, federal law(s) in his/her jurisdiction. Specifically, the USER/MEMBER/BUYER must not use the information contained on this website to attempt to place a bet/wager/gamble if doing so violates any local, state, national or federal law.


9.8  USER/MEMBER/BUYER must only use the Content on his/her own individual behalf and must not share the information with any person(s)

In the event that it is proven that USER/MEMBER/BUYER violated this clause, the USER/MEMBER/BUYER specifically agrees to compensate the SUPPLIER for damages caused by this action, including but not limited to punitive damages.


9.10  USER/MEMBER/BUYER must not make any commercial use whatsoever of CONTENT provided by the SUPPLIER.


9.11  USER/MEMBER/BUYER is entirely responsible for his/her use of CONTENT at WEBSITE or any information communicated to him/her by SUPPLIER. USER/MEMBER/BUYER agrees that he/she will not under any circumstances hold SUPPLIER responsible for his/her actions.


9.12  MEMBER/BUYER is entirely responsible for his/her password and login details and agrees not to share these with any person(s). In the event that it is found that the account created by USER/MEMBER/BUYER has been used by any other person(s), the SUPPLIER reserves the right to suspend any use of that account, with no refund in the event that the account belongs to BUYER.


9.13  USER/MEMBER/BUYER agrees not to attempt to in any way harm the smooth functioning of WEBSITE.


9.14  USER/MEMBER/BUYER must comply with all other obligations contained within the TERMS AND CONDITIONS or which are required by any applicable law.


9.15  In the event that USER/MEMBER/BUYER does not carry out his/her responsibilities under TERMS AND CONDITIONS, SUPPLIER may disrupt his/her access to the SERVICE and/or the WEBSITE through any means. SUPPLIER will not be liable for any claims in this regard and SUPPLIER reserves the right to pursue further legal action, including but not limited to filing for damages.


 


10.  PAYMENT


10.1  SUPPLIER reserves the right to alter the payment procedure or the prices charged for any subscription at any time without prior notice. However, SUPPLIER and BUYER agree that any changes to the price of any subscription will not apply to any existing subscription.


10.2  SUPPLIER uses payment processing services to process payments and users are directed to these payment processor websites at the time of payment. No payments are ordinarily processed directly by SUPPLIER. SUPPLIER is therefore in no way responsible for the security of financial information. Please check the Terms and Conditions of the relevant payment processor for details on all issues relating to the security of financial information.


10.3  In the event that SUPPLIER agrees to directly process any payment, SUPPLIER reserves the right to impose any additional stipulations specific to the payment procedure.


10.4  BUYER agrees that he/she legally owns and controls the funds used to pay for his/her subscription.


 


11.  REFUND POLICY


11.1  BUYER may claim a refund on his purchase during the first 7 days, if and only if SUPPLIER has not yet started to process BUYER order. If BUYER account has been activated by SUPPLIER or if the account has been activated at the time of payment, BUYER shall not receive any refund under any circumstances. Ordinarily, since accounts are activated at the time of payment, the BUYER will NOT be entitled to any discounts. Decisions of the SUPPLIER in this regard shall be final.


11.2  If BUYER requests a refund before SUPPLIER has begun to process the BUYER’S order, he will receive a refund within a period of 90 days subject to (i) a 15 EURO administrative fees charge and (ii) any payment processing charge(s) incurred. That is, these charges shall be deducted from the amount paid by the BUYER and BUYER shall receive the remaining amount.


11.3  Once the BUYER account has been activated by the SUPPLIER, BUYER agrees not to attempt to reverse the payment through any means whatsoever.


 


12.  CLOSING AN ACCOUNT


12.1  MEMBER/BUYER may close down his/her account by requesting that his/her account be closed down. All such requests must be made from the users registered e-mail account.


12.2  SUPPLIER may close down any account belonging to any USER/MEMBER/BUYER in the event that it is found that USER/MEMBER/BUYER has violated any clause of the TERMS AND CONDITIONS. Moreover, SUPPLIER may close down or limit access to an account under reasonable suspicion of any such violation having occurred. Specifically, if SUPPLIER finds that USER/MEMBER/BUYER has made any attempt to violate these TERMS AND CONDITIONS, SUPPLIER reserves the right to ban the users account even if such attempt was unsuccessful.


12.3  SUPPLIER may block access to an account if he assesses that allowing access to the account may expose SUPPLIER to any additional risk. Specifically, if SUPPLIER finds that SUPPLIER may be liable to the provisions of law of any specific country, SUPPLIER may block access to any USER/MEMBER/BUYER from that country.


 


13.  ADVICE


13.1  CONTENT does not constitute advice or professional advice and should not be relied upon while making or refraining from making any decision. Moreover, CONTENT should not be relied upon as an instruction to in any way gamble, place a wager or place bets.


 


14.  LINKS TO THIRD-PARTY WEBSITES


14.1  This website contains links to third-party website. SUPPLIER accepts no responsibility for the smooth functioning of such links.


14.2  SUPPLIER makes no representation or endorsement regarding the business practices of such third party links.


14.3  It is the responsibility of the user to ensure the legality of use of such third-party links. SUPPLIER make no claims or representations regarding the legality of visiting or using such third-party websites.


 


15.  SPECIAL PROVISIONS


15.1  USER/MEMBER/BUYER explicitly states that he/she does not work for or represent any bookmaker, sportsbook, casino, odds compiling organization of any nature of any entity that may hold vested interests in CONTENT made available at the WEBSITE.


15.2  USER/BUYER/MEMBER agrees that SUPPLIER may use any communication between USER/MEMBER/BUYER for promotional purposes by quoting the USER/MEMBER/BUYER first name and Location only. If USER/MEMBER/BUYER objects to such use of First Name and Location, USER/MEMBER/BUYER must e-mail SUPPLIER at support@sports-investor.net and inform him of the same. In all such cases, SUPPLIER will be allowed a period of 30 days after SUPPLIER confirms receipt of e-mail to apply such changes.


15.3  USER/MEMBER/BUYER must not use any proxy device or IP Address masking device to access this website. In the event that it is reasonably determined that USER/MEMBER/BUYER may be using any such device, SUPPLIER reserves the right to suspend USER/MEMBER/BUYER account with no refund.


 


16. DISCLAIMER AND PRIVACY POLICY


16.1  USER/MEMBER/BUYER must understand and agree to the Disclaimer available via links at the bottom of each page on WEBSITE or at www.sports-investor.net/disclaimer.php in order to use WEBSITE and/or SERVICE. 


16.2  USER/MEMBER/BUYER must understand and agree to the Provacy Policy available via links at the botton of each page on WEBSITE or at www.sports-investor.net/privacy-policy.php in order to use WEBSITE and/or SERVICE. 


 


17.  SEVERENCE


17.1  If any of these TERMS AND CONDITIONS should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining TERMS AND CONDITIONS shall remain in full force and effect and continue to be binding and enforceable.


 


18. CHANGES TO TERMS AND CONDITIONS


18.1  TERMS AND CONDITIONS may be changed at any time by SUPPLIER without prior notice or approval. SUPPLIER is not responsible for communicating to USER/MEMBER/BUYER that changes have been made.


18.2  SUPPLIER is responsible for immediately updating TERMS AND CONDITIONS as outlined on WEBSITE, should such a change be implemented.
